The Fugitive Economic Offenders Act, 2018: Economic Justice or Symbolism?

Abstract
The developments that have taken place regarding economic crimes in the last decade in India have brought about a transformation in the manner in which enforcement of criminal laws is carried out in India. The advancement of financial crime and the ability of the criminals involved to cross borders make it difficult for the criminal justice process to take place because the State cannot be able to bring these individuals under its jurisdiction. This has not only hindered the conduct of the trial but has also slowed down the recovery process of the funds. It is against this backdrop that the Fugitive Economic Offenders Act, 2018 (FEOA), was introduced as a statutory measure to plug these structural loopholes by placing greater emphasis on seizing the economic wealth of the accused rather than ensuring their physical presence. The provisions of the FEOA allow the courts to seize the property of such offenders who avoid legal proceedings by staying outside India.
