Corporate Policy Advocacy and Regulatory Reform: Streamlining Statutory Bidding Workflows in Emerging Energy Markets
Subject area: Management and Commerce · Area of research: Energy Policy and Regulatory Management
Abstract
Emerging energy markets have converged on competitive bidding as the dominant mechanism for procuring new generation capacity, yet the statutory workflows that govern these bids remain slow, fragmented, and administratively costly. Between the publication of a determination or tender notice and the achievement of financial close, projects in many emerging markets pass through between eleven and nineteen discrete statutory or quasi-statutory approval gates, distributed across ministries, regulators, offtakers, environmental agencies, land authorities, and treasury functions. This paper examines how corporate policy advocacy, understood as the organised, information-based influence activity of firms and industry associations, shapes regulatory reform aimed at streamlining these workflows. Drawing on a comparative qualitative case design covering South Africa, India, Brazil, Nigeria, and Vietnam over the period 2010 to 2019, and combining documentary process tracing with a workflow mapping protocol adapted from business process reengineering, the study advances three findings. First, the binding constraint on bidding timelines in most emerging markets is not the auction mechanism itself but the sequencing and interdependency of pre-award and post-award statutory gates, particularly those involving sovereign credit support, land acquisition, and grid connection consent. Second, advocacy is most effective when it operates as a legislative and administrative subsidy, supplying regulators with drafting capacity, comparative precedent, and technical evidence, and least effective when it takes a purely adversarial or distributive form. Third, streamlining reforms that deliver durable gains share four institutional features: a single accountable procurement entity, standardised and non-negotiable contract documentation, statutory decision deadlines with defined consequences for silence, and a formalised, transparent consultation channel. The paper sets out a sequenced diagnostic and reform approach built on these findings and derives implications for regulators, industry associations, and development partners. It concludes by distinguishing the conditions under which advocacy produces welfare-enhancing simplification from those under which it produces regulatory capture disguised as efficiency.
