Abstract

This article examines the emerging field of emotion-tracking artificial intelligence (AI) and its implications for data privacy and legal frameworks. As technologies capable of detecting, analyzing, and responding to human emotions become increasingly sophisticated and widespread, they create unprecedented challenges for privacy regulation. This analysis explores the current legal blind spots surrounding emotion-tracking AI, evaluates existing regulatory frameworks across multiple jurisdictions, and proposes potential pathways for policy development that balance technological innovation with fundamental privacy rights. By identifying the unique characteristics of emotional data and the novel risks they present, this article contributes to scholarly discourse on the future of data privacy in an era of ambient emotional intelligence.
